Immigration stories are a cornerstone of America’s historical narrative. From grade school we learn of the Pilgrims’ trans-Atlantic journey to flee religious persecution and of “a mighty woman with a torch” who greeted European immigrants by the millions to Ellis Island. In these stories, tolerance and generosity are singularly American virtues that confer our country’s greatness.

Unfortunately, incomplete immigration stories linger in the present day, obstructed by opposition from a loud and persistent few. As a result, 11.8 million undocumented immigrants live in America’s shadows – they struggle to finance their educations as students, are exploited as workers, and are encumbered by an ever-present fear of deportation as families.

In a recent Huffington Post entry, Will Perez wrote that immigration reform “is of particular concern to Latinos, since 75% of undocumented immigrants are from Latin America.” However, the problems engendered by our immigration system affect a vastly diverse immigrant population. It is estimated that 10 percent of Asian American Pacific Islanders (AAPIs) are undocumented, and among the AAPI groups, Korean Americans are affected at the greatest rate, at 20 percent.

The history of Korean immigration to the U.S. is one variation on the American immigration narrative. Immigration began in the late 19th century, as Koreans came to work as laborers in Hawaii, but the bulk of it occurred after 1965 following the repeal of the Asian Exclusion Act. Legions of Koreans came to America in search of freedom from an oppressive political regime and opportunity for economic mobility. Nearly a quarter million Korean Americans are undocumented as the result of this promise of a better life coming into conflict with the realities of the immigration system.

Undocumented Korean American college students have been especially vocal in the fight for immigration reform. The stories of the measures taken by these students and their families to support a college education give the push to pass reform a special sense of urgency. Their hardship extends well beyond their ineligibility for financial aid. A huge question mark looms over their post-graduation plans – without a Social Security number, how are they to find employment? On February 1, one Korean American student reiterated these frustrations and spoke of his aspirations to become a professor before hundreds who had gathered at a Los Angeles church for an immigration town hall. And Ju Hong, an undocumented student from the Bay Area, has come out publicly about his status and blogs regularly on immigration issues.

As the immigration reform movement escalates in size and intensity, undocumented Korean American students will continue to make their voices heard. On March 21, over 100,000 people from every corner of America will come together in Washington D.C. to show their support for immigration reform in a “March For America,” and Korean Americans from California to New Jersey will be among them.

Eric is an undocumented Korean American student at an Ivy League university. He has taken the school year off in order to work and save money to pay for college; he waits tables at a Japanese restaurant 7 days a week, 12 hours a day on weekdays, and 13 hours a day on weekends. Despite his busy schedule, Eric will be coming to Washington on March 21 to march for immigration reform because, as he tells it, reform is not only his dream, but is “the dream of thousands of fellow immigrants who work hard to become American citizens in the land of opportunity.”

Immigration reform cannot wait, and the Korean American community will be present in Washington standing alongside other immigrant groups to encourage our legislators to take the action that America needs.

“In dreams, immigration officials rushed in and arrested me,” said Ju H. “I woke up sweating. My heart was pounding.”

Eyes tearing, the 20-year-old immigrant without citizenship documents from South Korea and current community college student in the San Francisco Bay Area continued telling his story to advocates, lawmakers and students at a crowded Capitol summit in Sacramento on Wednesday.

He described barriers to federal and state help for himself and others like him seeking education at four-year institutions. The walls to such schooling would fall with passage of the federal Development, Relief, and Education for Alien Minors (DREAM) Act, first introduced in Congress in 2001.

The bipartisan legislation was re-introduced in March 2009 in the 111th Congress as S. 729 and H.R. 1751. This proposed bill would allow tens of thousands of students whose undocumented parents brought them to the United States, where they grew up, attended schools and worked, to access many forms of financial aid to achieve the “American Dream” of gaining a higher education degree and securing stable employment afterwards.

For example, the DREAM Act would amend current federal immigration law and allow states to grant residency status to undocumented youth who have graduated from high school. This, in turn would qualify such students for state college tuition, less costly than what non-residents pay.

In addition, the DREAM Act would allow these students to receive federal grants and be eligible for work-study programs at higher education institutions.

Speakers at the summit made clear the political obstacles to passing the DREAM Act.

“Today is a time of fierce anti-immigrant hysteria,” said State Senator Gilbert Cedillo (D-LA). “But I have optimism in spite of this with President Obama who ran on a platform of hope and change, plus a business community that understands the vital role of immigrants in the state economy.”

The expansion of an educated American work force itself is a policy of economic stimulus, the president has said.

Cedillo and his fellow lawmakers at the DREAM Act summit drew parallels between the Civil Rights Movement of the 1950s and 1960s, which overcame discrimination against African Americans to the passage of the DREAM Act today.

“This is a continuing movement for civil rights,” said State Assemblymember Warren Furutani (D-Long Beach). State Senator Curren Price (D-LA), concurred with Cedillo and Furutani, noting the urgent need to remove barriers to higher education for undocumented students.

The College Board Advocacy & Policy Center, and the Latino, Black and Asian Pacific Islander Legislative caucuses, sponsored the DREAM Act summit in Sacramento. According to the College Board, 65,000 undocumented students graduate from high schools across the nation each year. In California alone, there are an estimated 26,000 undocumented youth, according to a 2006 Pew Foundation study.

They need allies to improve their educational opportunities after high school, said Kent Wong, an attorney, UCLA professor and director of the Center for Labor Research and Education. “These students were brought to this country through no decision of their own by parents and relatives looking for a better life,” he said.

The arc Wong described fits the life of Ju H. His mother, after a bankruptcy and divorce in South Korea, brought his sister and him to America nine years ago. He is studying political science and hopes to attend UC Berkeley in the future.

With the state budget deficit growing after the housing crash due to falling property and sales tax revenues, California lawmakers have hiked fees by double digits for students in the UC and California State University systems. With these costs rising, the dream of attending a state college or university could be fading fast for undocumented students with high school diplomas.

“We need your help in leadership roles to help us pass the DREAM Act in 2010,” said Ju H.

현행 병역법은 재외국민에게 한결 많은 혜택을 주고 있다. 35세 이하 영주권을 가진 남성의 한국 체류기간이 연간 통산 6개월 이상이 되면 병역이 부과된다. 연간 수 차례 한국을 방문해도 방문 횟수와는 상관없이 한국에서 순수하게 거주한 기간을 기준으로 연중 절반이상(183일)을 거주해야 병역 부과대상이 된다. 따라서 영주권자나 시민권자 등 국외이주자가 병역의무의 부담 없이 한국에 거주할 수 있는 기간을 실질적으로 연장한 셈이다.

재외국민 2세는 6세 이전부터 18세가 될 때까지 부모와 계속 국외에서 거주한 사람. 곧 부모와 본인이 영주 또는•시민권자인 사람을 말한다. 여기서 ‘계속 국외거주 여부’는 통산 3년의 범위 안에서 한국의 초•중•고교에 수학했거나 연간 몇 차례 단기간 한국을 방문한 사실이 있어도 실제 생활근거지가 외국인 경우는 계속 해외에서 거주한 것으로 인정된다.

이들 2세에 대해서는 영주권을 포기하고 한국으로 영구 귀국하기 전에는 병역을 의무적으로 부과하지 않으므로 ‘연간 통산 6개월’ 기준의 적용을 받지 않는다.

대한민국 남성으로서 18세부터 35세까지 병역의무를 마치지 않은 사람이 국외여행을 할 때는 병무청장의 허가를 받아야 한다.

유학생의 경우 고등학교는 21세, 대학은 25세, 대학원은 27세(박사과정 28세)까지 허가(병역연기)를 받을 수 있다.

영주권자는 35세까지 허가를 받지만, 부모 가운데 어느 한쪽만 취득한 경우는 2년 범위 안에서 35세까지 계속 연장이 가능하다.

이중국적자도 35세까지 연장할 수 있다.
문제가 되는 경우는 미국에서 출생한 태생적 이중국적자들인데 이 경우에도 병역대상자가 되기 전(17세가 되는 해의 12.31까지)에 국적이탈신고를 하여 미국시민권만 보유하면 문제가 없으나, 신고를 하지 않고 한국국적을 계속 보유한 경우에 병역문제가 발생합니다.
국적이탈신고 기회를 놓친 경우에는 전가족 영주권(또는 시민권) 취득으로 병역 별도 관리
허가를 받은후 만 35세까지는 이중국적을 소지하게 됩니다. 국적상실 및 국적이탈 신고는 재외공관 또는 한국의 출입국관리사무소에서 가능합니다.

허가(병역연기) 취소대상자

다음과 같은 경우 국외여행허가와 병역연기 처분을 취소하고 병역의무를 부과한다.

1. 해외이주법 규정에 따라 영주 귀국을 신고했거나
2. 1년 기간 내 통산 6개월 이상 한국에 체재하는 경우
3. 한국의 교육기관에서 수학하는 사람으로 수학기간 중 부모 중 한쪽이나 배우자가 1년
기간 내 통산 6개월 이상 한국에 머무는 경우
4. 영리활동에는 1년의 기간 내 통산 60일 이상 머물면서
• 봉급•급료•임금 등의 급여를 받는 경우
• 농•공•상업 등 각종 사업을 운영하는 경우
• 연예인•예술가•운동선수 등이 공연•방송•영화출연•경기참가 등으로 활동하며 수입을
올리는 경우

패트릭 주지사, 주민과 같은 등록금 허용 등
131가지 추천안 포함 서류미비자 혜택 발표

드벌 패트릭 매사추세츠 주지사는 17일 불법 이민자들에게 주어질 혜택에 관한 보고서를 발표했다. 모두 131가지의 추천안을 포함하고 있는 “New American Agenda”라고 명명된 이 보고서는 매쓰 주내에 거주하고 있는 서류 미비 이민자들에게 운전면허증을 부여하고 주립대학에 입학할 경우 주민과 같은 금액의 등록금을 내도록 허용하는 내용, 그리고 외국 출생의 이민자들에게 영어 클래스를 제공하는 내용 등을 골자로 하고 있다.

이 보고서는 패트릭 주지사의 발의로 작년부터 올해 초까지 이민자 옹호단체들과 가졌던 공청회에서 제기되었던 가장 큰 이슈들에 대한 해결책들을 포함하고 있다. 보고서는 작년 7월부터 모두 26만 달러의 예산을 들여 용역을 의뢰한 가운데 매쓰 주 서부의 스프링필드로부터 보스턴에 인접한 첼시까지 이민자 거주 지역을 대상으로 모두 1,200명의 서류미비 이민자들을 인터뷰 한 결과를 바탕으로 작성되었다. 그러나 패트릭 주지사가 이번 보고서에 발표된 추천안을 즉각 수용할 지에 대해서는 아직 확실하지 않다.

사실 이날 발표된 보고서도 이미 지난 7월에 완성된 것인데 4달여를 가지고 있다가 이날 발표한 것이었다. 카일 설리반 주지사 대변인은 90일 이내에 구체적인 시행여부가 결정될 것이라고 밝혔다. 패트릭 주지사는 이날 보고서를 발표하는 자리에서 “매사추세츠 주의 주지사로서 여러분들은 앞으로 우리 주는 물론 미국 전체의 이익에 대한 이민자 정책 개혁 과정에서 나오게 될 여론에 도움이 될 수 있기를 바란다”고 밝혔다. 주지사 직속기구인 망명자 및 이민자 대책위원회의 웨스티 에그몬트 보좌관은 “우리는 이민자 문제에 관해서 논쟁할 것이 아니라 장기적인 국가이익에 관한 관점에서 구체적인 정책적 결정이 이루어지도록 힘을 모아야 할 것”이라고 밝혔다.

패트릭 주지사는 주 전체 인구의 14퍼센트에 해당하는 91만 2,310명의 이민자들에 대해 호의적인 제스추어를 취해 왔지만 대표적인 예로 서류미비 이민자들에게 주민 주립대 등록금을 적용시키는 안건에 대해서 충분한 로비를 하지 않았다는 이유로 이민자들을 실망시킨 바 있다. 매사추세츠 주의 이민자 구성은 캘리포니아 또는 텍사스와는 다르다. 전체 이민자의 4분의 1이상이 석사학위 이상의 교육을 받은 사람들이다. 그러나 전체의 43퍼센트는 자신이 영어를 잘
말하지 못한다고 답한 것으로 나타났다. 이번 권고안 중에는 전문적인 교육을 받은 이민자가 본국에서 받은 경력증명서 등을 인정해 주자는 항목도 있었다.
이럴 경우 공립학교에는 외국어를 하는 교직 경력자를 다중언어 보조교사 등으로 활용할 수 있는 길이 열리게 되며, 기술 특허 등의 소지자가 매쓰 주에서 창업할 경우 은행융자를 받는 길을 열어주어 보다 많은 투자를 유치할 수도 있게 된다. 그러나 반대의 소리도 일고 있다.

이민 반대론자들은 이미 심각한 지경에 이르고 있는 주 정부 예산적자 문제를 고려할 때 서류미비 이민자들에 대해 주민과 같은 주립대 등록금을 적용해 주는 것은 불공평하다는 반응을 보이고 있다. 운전면허에 대해서도 만약 매사추세츠 주가 불법 이민자들에게 정식 면허증을 발부하게 된다면 이는 연방정부의 “리얼 아이디 법안”을 뒤엎는 결과가 된다는 반응이 나오고 있다. 이 보고서의 권고안은 주지사 선거가 있는 내년도에 의회를 통과해 주지사가 서명하는 과정을 거치게 되면 법으로의 시행여부가 결정되게 된다. <박성준 기자>

진정한 가난

두 사람이 랍비에게 상담하고자 찾아갔다. 한 사람은 그 고장에서 제일 가는 부자이며, 또 한 사람은 가난한 사람이었다.

두 사람은 대기실에서 기다리고 있었다. 더 일찍 온 부자가 먼저 랍비의 방으로 들어갔다. 그리고 한 시간이 지나서 방에서 나왔다.

다음에 가난한 사람이 방으로 들어갔다. 그와의 면담은 5분으로 끝났다. 가난한 사람은 언짢은 생각이 들어 랍비에게 항의했다.

“부자와의 면담은 한 시간이나 걸렸습니다. 그런데 저는 단 5분이 걸렸을 뿐립니다. 이것이 공평한 건가요?”

“진정하세요. 당신은 자신의 가난함을 알고 있었지만 부자는 자신의 마음이 가난하다는 것을 알기까지 한 시간이나 걸렸답니다.”
